GENERAL TERMS

PREAMBULUM
The main organizer of ARTplacc Contemporary Art Festival and fair is Mono Art Nonprofit Ltd.

1. CONDITIONS OF PARTICIPATION
The applicants are required to send back the duly completed application form until the specified date in order to participate in the festival. Items admitted for exhibition: paintings, works on paper, multiples, original graphics in limited, signed and numbered editions, sculptures in the original and as an edition, installations/objects, photographs in the original and in limited, signed and numbered editions, publications/art books/magazines/catalogues on the subject of the fine arts, video art works and installations. A valid business license is a prerequisite for admission to exhibit at the fair. An application must contain the following information: general information about the gallery, represented artists, information on the artists whose works will be shown at the fair, short description of the concept of the common stand (2000 characters), fresh description of the gallery (statement) (1500 characters), vector logos of the gallery(ies), interior photos of the gallery(ies). The application can be submitted via e-mail, by sending the duly completed application form affixed with the applicant’s authorized signature. The Organizer shall inform the applicant whether the application has been accepted or rejected within 15 working days following the submission of the application. The Organizer reserves the right to reject applications to exhibit without stating reasons, and to exclude individual works from the application list. If, during the exhibition, it turns out that an approved applicant (hereinafter referred to as: Exhibitor) is violating the present General terms and if such violations are not immediately remedied by the Exhibitor, or if justified complaints are made against an exhibitor for reasons such as making an untrue advertising message, the Organizer reserves the right to exclude the exhibitor in question from the event.

2. FAIR INFORMATION
ARTplacc Contemporary Art Festival and fair (hereinafter referred to as: Organizer) represents a platform for exhibitions of works of art. Galleries, art dealers and art publishing houses may participate in the event which operate on a supra-regional and regional basis, and fit into the concept of the art festival and fair. ARTplacc exhibition platform also provides an opportunity to sale art publications and individual works created from 1989 onwards. The Organizer is entitled to postpone, cut short or cancel the exhibition. Should the exhibition be postponed or cut short in whole or in part - unless the Organizer and the Exhibitor (hereinafter jointly referred to as: the Parties) have otherwise agreed - this Agreement shall be deemed to be concluded for the new date and the new duration. Once the registration has been completed it cannot be subsequently withdrawn. By confirming the application, the contract is considered as concluded between the Parties simultaneously.

1. PARTICIPATION FEE, TERMS OF PAYMENT:
10 sqm wall surface without charge
extra 10 sqm wall surface 45.000 HUF + VAT
The presentation automatically includes in addition to the wall surfaces 2 lamps/walls, 1 chair, a go-and-return transfer from the foreign location in question to Tihany up to a total of 2 sqm, storage up to a total of 2sqm for the period and conditions detailed under point 6. Point 5.2. includes additional information on the fees of further demands. The participant galleries are automatically entitled to receive 5 weekly passes and 5 daily tickets. The Organizer of the fair is entitled for a 10% commission on all sales.
The extra wall rental fee shall be paid after the registration is being confirmed, in a single instalment, within 10 days from the receipt of the invoice through bank transfer to the bank account provided by the organizer.

3. SUBLETTING
Without the approval of the Organizer the Exhibitor is not entitled to sublet in whole or in part the stand provided to him/her, to leave it to third parties in any other way, to exchange it or to accept orders on behalf of a different company. The admission of one or more co-exhibitors approved by the exhibition management is subject to a charge.

4. INSURANCE

All participants by the registration are provided with an insurance protection for the total period of the fair including tranportation on the basis of a list of items handed in in advance to the Organizer. The Organizer shall not assume any liability for uninsured air and exhibition articles.
The exhibition site will be insured from 15 July 2014 to 21 July 2014.

5. TRANSPORT:
The registration fee includes a transport for the exhibitors’ items up to 2 sqm from the given location of the foreign participant-Tihany there and back. Above the aforementioned amount the transport is provided on a charge of 10 000 HUF/sqm/150 km.

5. STAND CONSTRUCTION AND LAYOUT:
5.1. STAND:
The stand walls consist of white wooden walls with a size of 210 cm X 230 cm/wall. It is not permitted for the height of the stand walls to be exceeded anywhere in the stand area, nor to place advertising elements such as advertising towers and company signs. It is prohibited to exhibit works of art or other contents which may be offensive on the grounds of race, religion, nationality, political opinions or freedom of conscience. The Exhibitor shall be responsible for labeling the stand, however, for an additional fee the Organizer undertakes to provide the labels for the Exhibitor. All stands are provided with 2 lamps which are included in the participation.

5.2. ADDITIONAL SERVICES
We can provide sockets as required on a charge of 2000 HUF+VAT/ socket/ 10 days.
We provide one chair for each stand, additional chairs and tables can be provided on a charge of 700 HUF+VAT/piece.
The installation of the stands must be in compliance with the fire safety rules. The fire safety rules are available on our website.

6. STORAGE ON SPOT
Packing materials for exhibition items are to be removed from the exhibition premises on the day of the preview, by 9:00, 16 July 2014, otherwise removal may be authorized to be carried out at the cost of the exhibitor. No responsibility is accepted by the organizer for the whereabouts of any materials not removed at the proper time. Packing materials and other items can be stored in the storage mounted near the exhibition area. The storage costs are without charge from 16.00 14 July 2014 to 12.00 21 July 2014, up to a total of 2 sqm, above the aforementioned amount the additional charge is 1000 HUF+VAT/sqm/day.

7. SETTING UP AND CLEARING THE STANDS:
The Exhibitor may occupy the stand and the hired surfaces from 10 am Tuesday, 15 July 2014 and shall be finished with the installation by 9 am16 July 2014.
It is not permitted to clear a stand – in whole or in part – before the official end of the exhibition.
Objects may be removed from the stand allocated to exhibitors only after the official end of the exhibition, until 12.00 21 July 2014. In the event that the stand has not been vacated by the aforementioned time, the Organizer shall be entitled to have the stand vacated at the exhibitor’s expense. In such case, the Organizer shall accept no liability for due clearance and storage of the exhibition objects. Storage costs shall be borne by the Exhibitor. The exhibition area shall be returned in the same state as taken over by the exhibitor, who shall be liable for damage to the floor, walls and material rented or lent to him/her. Walls shall be returned in white colour.

8. SURVEILLANCE:
The general surveillance of the property and the halls is ensured during the official set- up and clearing times, as well as during the fair by the Organizer, however, the latter shall not be liable for the Exhibitor’s possible losses or damages which do not fall under the general surveillance.

9. CLEANING:
The Organizer organises cleaning in general. The Exhibitor is responsible for the maintenance, cleaning and surveillance of his own exhibition area and exhibition articles. Daily stand cleaning must be finished before the start of the official fair visiting time. Outside opening hours, exhibitors may stay in the halls for half an hour before and after the official opening times.

10. NON-LIABILITY:
The Organizer under no circumstances shall be liable for the failure of the event due to the following force majeure events: fire, natural disasters, acts of terrorism, war, riot or strike. The Organizer is not responsible for damage incurred to people or things in the exhibition halls, on the exhibition premises and in the parking lots. It is not responsible under any circumstances for elementary, accidental, vehicle and theft damages, as well as further damages of any kind. The Organizer assumes no liability for loss or damages regarding the goods provided or left behind by the Exhibitor or a third party. It is not responsible for damages resulting from the Exhibitor/Exhibitor relationship, or Exhibitor/visitor relationship. Activities which may cause damage in the site or personal injury are not permitted, as well as touching the complete electrical system, the use of open flames or devices which may cause fire.

11. ADVERTISING ON THE EXHIBITION SITE:
Exhibitor advertising must be limited to the stand allocated to the exhibitor. Advertising on behalf of third parties is only permitted with the written approval of the Organizer. Advertisement posters and flyers may not be affixed or distributed outside the allocated stand. The Organizer is entitled to remove or stop unauthorised posters and flyers or other advertising means without consulting the exhibitor or taking legal action. Flyers or posters that have already been mounted or distributed outside the exhibitor’s stand shall be removed at the expense of the party responsible. Promotion activities outside the stand shall be permitted in exceptional cases only and are subject to the written approval of the Organizer. All promotional activities at the stand and the contents of the advertising messages must comply with ethical principles. In case of doubt, the Organizer must be consulted. With regard to microphones, music and loudspeaker systems, the Organizer reserves the right to adjust the volume or, if necessary, to shut down any such system.

12. PHOTOGRAPHS, DRAWINGS, FILM RECORDINGS:
The Exhibitor shall ensure to the Organizer the possibility of taking photographs, drawings and film recordings of exhibition items and to use these for publication in order to promote and document the event.

13. FINAL PROVISIONS:

Any claims of the exhibitor must be asserted by registered letter to the Organizer within 14 days following the end of the exhibition. Any claims raised subsequently to this have no entitlement to consideration and will be regarded as groundless. By completing the registration form, each exhibitor acknowledges, both for itself and for the persons appointed by it, the above conditions and all regulations of the local police and trading authorities and other applicable regulations and provisions. In the event of any contravention of the conditions, the Organizer is entitled to announce and execute the exclusion of the exhibitor in question from the exhibition without notice. Any verbal additions to this contractual agreement must be confirmed in writing by the Organizer in order to be valid. The information on exhibitors which is submitted with the registration will be processed by computer and used for purposes which are primarily intended for the execution of the exhibition event. The Organizer is entitled to use data relating to exhibitors for its own marketing and advertising purposes, and to pass on such data if appropriate.
For any matters not governed by this agreement, the Hungarian Civil Code shall apply.
